Welcome to Easier Levels!

Easier Levels is delighted to be providing you climate intelligence services. We provide our services under the condition that you accept these terms. Upon receipt of your payment for our services, Easier Levels shall provide the services to you. You acknowledge that by receiving our services and paying the related fees, you agree to be bound by these terms.

Please note: the meaning of the words “you” and “your” appearing throughout these terms means you and the entity or business you represent, which may include as applicable a company, a group including all subsidiaries and associate companies, and a parent company. And the meaning of the words "Easier Levels", "we", "our" and "us" mean the Easier Levels company you contract with and pay fees to for our services. You can find which company you contract with in the section 'Easier Levels Companies' following below these terms.

Easier Levels takes your privacy seriously. During the course of providing our services to you, Easier Levels will treat information received in utmost confidence.

You may use the materials provided to inform your climate results however you may not reproduce or share the materials, and are not permitted to use the materials for a commercial product or for any other purpose such as training or conferences.

Prior to using any materials provided for any purpose other than the services, you must obtain express written permission from Easier Levels, and Easier Levels may charge you a fee for any such use of the materials provided.

All intellectual property in Easier Levels pre-existing materials remains our property, and you acquire no right in the material provided including all components of our services such as rights in the design, assembly, and user interface, report content and designs. As an exception Easier Levels acknowledges the base data you provide to us is your property. All work, programmes, methodologies, systems, knowledge and expertise developed or applied by Easier Levels in the performance of the services provided by Easier Levels shall remain our property. 

You shall not apply such programmes, methodologies and/or systems beyond the duration of the services. You agree to not copy, distribute, modify or make derivative works of any of our content or use any of our intellectual property rights in any way not expressly permitted by Easier Levels.

Easier Levels is not providing professional advisory services, and you should not construe any of the business suggestions we make to you to be professional advice. Our services are provided subject to service disclaimer which is available in the section below these terms.

You agree to accept our service as is, and will not be able to sue for damages, and Easier Levels makes no warranty for the usage. We have no liability arising from your use of our services for any loss. If, contrary to this intention, Easier Levels is held liable under any liability to you in connection with our services or these terms, in contract, tort (including negligence) or otherwise, in any circumstances such liability shall be limited to specific special damages totalling the amount you paid us in the most recent year. This limit shall apply to all claims made, or events the cause of action in respect of which arose, in any one year and to any related series of events.

In relation to your use of our services, except in so far as we are at fault, you indemnify us against all actions, claims, costs, expenses, damages, losses, demands, fines or liability arising out of or in connection with the services provided.

Your rights to use our services are non-exclusive, and Easier Levels may allow other parties to use our services.

You may not transfer any aspects of this agreement to another party including (but not limited to) use of our data, content and services.

Easier Levels values your open and honest feedback on the service provided including the value of the service and any areas for improvement, and may use the feedback without any restrictions.

Nothing in these terms should be construed as constituting a partnership, joint venture, employment or agency relationship between you and Easier Levels.

You may terminate the service at any time with one month's advance written notice, normally sent via email.

We may choose to terminate your service at any time with one month's advance written notice, normally sent via email. At that time, if you have prepaid for services of a longer duration than the notice period, depending on the circumstances relating to termination, unless you have breached any of these terms we may at our sole discretion agree a partial refund.

If you do not follow any of these terms then it will result in a breach of contract and Easier Levels can revoke your customer privileges as a result and may terminate your service. 

The parties shall actively and in good faith negotiate to achieve the speedy resolution of any dispute or difference which may arise between them concerning any matter arising. Regarding any matters that cannot be easily resolved in the normal course of business through open communications channels you agree to resolve the dispute via mediation and binding arbitration rather than in court, and in your individual capacity, not in class action.

Easier Levels may change these terms from time to time, and when there are any material changes we will notify you.

All matters shall be governed and shall take effect in accordance with the laws of the relevant jurisdiction in the section below and you agree to submit to the non-exclusive jurisdiction of the courts of the relevant jurisdiction.
